eBuiz will strive to deliver within these timelines but is not liable for delays caused by the client.

2. Hosting & Business Email

• One year of standard shared web hosting is included with the Starter, Business, and eCommerce packages.
• Business Email accounts (as specified per package) are provided with standard storage (approx. 15GB per ID, may vary by provider) for one year.
• **Renewal charges for hosting and business email will be applicable from the second year onwards at the prevailing rates at the time of renewal.** Clients will be notified with the renewal invoice detailing the applicable charges well in advance of the service expiry date. Failure to renew may result in suspension of services.
• **eBuiz facilitates domain registration and hosting services, often utilizing reputable third-party providers. While we manage the setup, eBuiz is not responsible for the independent operational uptime, performance, security policies, or terms of service of these third-party domain registrars or hosting companies.**

3. Domain Name Purchase

• If the client does not own a domain name, eBuiz can purchase a `.com` or `.in` domain name on behalf of the client for an additional charge of ₹1,000 + GST. Domain ownership will be with the client upon request after full payment.
• Availability of the desired domain name is subject to registration availability at the time of purchase.
• Clients wishing to use other domain extensions (e.g., `.co`, `.org`, `.net`) must purchase them independently and provide access/details to eBuiz for website setup.

4. White Labelling / Attribution

• By default, websites developed by eBuiz will include a small attribution link in the footer (e.g., "Website Designed by eBuiz").
• Clients who wish to remove this attribution (white labelling) must opt for it at the time of placing the order by paying an additional, non-refundable fee of ₹1,000 + GST. This cannot be opted for after the project has commenced.

5. Client Responsibilities & Content

• The client is responsible for providing all necessary website content, including text, high-resolution images/photographs, brand logos, and any other required materials (like product details for eCommerce).
• All content must be provided to eBuiz within **5 working days** of signing up or placing the order to ensure timely project commencement and adherence to delivery timelines.
• Delays in providing content, feedback, or necessary approvals by the client will directly impact the project timeline and may void refund eligibility related to delivery timelines. eBuiz shall not be held responsible for such delays.
• The client warrants that they own or have the necessary rights/licenses for all content provided to eBuiz and indemnifies eBuiz against any claims related to content infringement.

6. Design & Revision Policy

• eBuiz will share the initial design draft/concept or functional website structure ("First Cut") based on the package scope and client-provided content within a reasonable timeframe (typically within the first third of the estimated delivery period).
• **Revision Rounds:**
  • Starter Package: Includes **one (1)** round of revisions on the First Cut.
  • Business & eCommerce Packages: Include up to **two (2)** rounds of revisions on the First Cut.
• Revision requests for each round must be consolidated and communicated clearly (preferably in writing/email) by the client within **3 working days** of receiving the draft/revision from eBuiz. Failure to provide timely feedback may cause delays.
• Revisions pertain to adjustments on the provided design/structure. Significant changes to the scope, layout, or core functionality requested after the initial agreement or after approval of a draft may be considered additional work and subject to extra charges and timeline adjustments.
• Any further revision rounds requested beyond the included number will be chargeable at a mutually agreed rate.

7. Money-Back Guarantee & Refund Policy (30 Days)

We offer a 30-day Money-Back Guarantee on our Starter, Business, and E-commerce packages, subject to the following conditions:

• **Eligibility Trigger:** A full refund (minus non-refundable costs) can be claimed **only if** eBuiz fails to deliver the **initial design draft/concept ("First Cut")** within **15 working days** from the date of receiving *all required content* from the client (as defined in Section 5).
• Alternatively, if the client is fundamentally unsatisfied with the quality or relevance of the *very first design draft/concept* provided, a refund request can be made in writing within 3 working days of receiving that first draft, *before* any revision rounds commence.
• The guarantee period is **30 calendar days** from the date of order placement. Refund requests based on the triggers above must be made in writing (email to contact@ebuiz.com) within this 30-day period.
• **Exclusions & Non-Refundable Conditions:** The Money-Back Guarantee is VOID and no refund will be issued if:
  • The project delay is caused by the client's failure to provide content, feedback, or necessary approvals promptly (as per Section 5).
  • The client requests significant changes to the project scope or requirements after the initial agreement.
  • The client has already requested or approved one or more rounds of revisions on the initial design.
  • Dissatisfaction arises *after* the initial design concept has been revised based on client feedback.
  • The 30-day guarantee period from the order date has expired.
• **Non-Refundable Costs:** Any approved refund will exclude non-refundable charges, specifically:
  • The specific fee paid for domain name registration (e.g., ₹1,000 + GST for .in/.com domains purchased via eBuiz) is non-refundable, as these fees are transferred to the domain registrar.
  • Any Goods and Services Tax (GST) collected as part of the original payment is non-refundable.
• Refunds, once approved, will be processed back to the original payment source within 15 working days.

8. Legal, Jurisdiction & Data Recording

• Upon form submission (Contact Form or Agreement Form), a timestamp will be automatically recorded by the processing system. While IP address recording via Apps Script is limited, system logs may capture associated request data for validation purposes, subject to platform capabilities. For database submissions (like T&C agreement), the IP address may be recorded as available to the server script.
• This agreement and all services provided shall be governed by the laws of India.
• Any disputes arising out of this agreement shall be subject to the exclusive jurisdiction of the courts located in Delhi NCR, India.
